PERSONAL INFORMATION PRIVACY NOTICE: By completing the form to enter the Sweepstakes you will be providing to us personal information such as your name and email address. This information may be used (i) to verify your eligibility to enter the Sweepstakes, (ii) to contact you to receive a Prize if you are chosen as a winner or (iii) to post your name and state of residence on our website(s) if you are chosen as a winner. This information may also be used to send you information about our company or our products or services, or to contact you when necessary. You will also be asked to provide us with your responses to survey questions regarding your use of our products or related products so that we may better understand our customers and their preferences. SWEEPSTAKES RULES*
Sweepstakes Sponsor: Sumitomo Rubber North America, Inc., a California corporation doing business as Falken Tire Corporation and Dunlop Motorcycle Tires (referred to herein as “SRNA”), is the sponsor of the Falken/Dunlop Losi ProMoto-MX RC Supercross Giveaway Sweepstakes (“Sweepstakes”) described in these Sweepstakes Rules and Privacy Notice (these “Rules”).
Eligibility: This Sweepstakes is open only to individuals (“Entrants”) who are residents of the United States and will be at least the age of majority in their state of residence at the time of entry. If you are not a resident of one of the United States or you will not be the required age as of the time of entry, you are not eligible to enter the Sweepstakes or to win a Prize. To be eligible to win a Prize, entries must be completed and received by SRNA as described below. One entry only per person. Directors, officers, and employees of SRNA and any of its affiliated and successor companies, or their respective professional advisors, advertising and promotional agencies, and Sweepstakes partners and prize suppliers, and immediate family members of any of them, are not eligible to participate. “Immediate family members” includes spouses, siblings, parents, children, grandparents, and grandchildren, whether as “in-laws”, or by current or past marriage, remarriage, adoption, co-habitation or other familial extension, and any other persons residing at the same household location, whether or not related. All applicable federal, state and local laws and regulations apply. Sweepstakes void where restricted or prohibited by law.
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS SWEEPSTAKES. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.
Odds of Winning: Odds of winning will be determined by the number of eligible entries received. Odds of winning are estimated to be 1:300,000, depending on participation. Limit one Prize per person. Odds may differ based on participation.
Sweepstakes Period: The Sweepstakes shall commence on January 11, 2025, at 10:00 a.m. PST and shall end on December 31,2025 at 7:00 p.m. PST (the “Deadline”). All entries must be received during this time period (the “Sweepstakes Period”) to be eligible to win the Prize. Any entries not received during the Sweepstakes Period will not be eligible, and such entries will not be considered. SRNA also reserves the right in its sole discretion to suspend or cancel the Sweepstakes or any Entrant’s participation in the Sweepstakes should causes beyond the control of SRNA corrupt the administration, security or proper play of the Sweepstakes or if SRNA otherwise becomes (as determined in its sole discretion) incapable of running the Sweepstakes as planned.
Prizes: Each winner will receive one Losi Promoto-MX RTR with a retail value of $599.00. The specifics of all aforementioned elements of the Prize shall be solely determined by SRNA. Some restrictions may apply. No substitution or exchange of the Prize or cash payment in lieu thereof will be permitted, except that SRNA reserves the right to substitute a prize of equal or greater value for the Prize or any portion thereof. The Prize is not assignable or transferable. THE PRIZE WILL BE AWARDED “AS IS” AND WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, (INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE).
How to Enter: Please complete the Sweepstakes Entry Form including: your affirmation that you are a resident of one of the states of the United States, are 18 years or older and are the age of majority in the state of your residence and your agreement to these Rules. You must complete the registration form in order for your entry to be eligible. Limit one entry per person. Incomplete entries will be disqualified. No purchase of any SRNA products is necessary to enter the Sweepstakes. Purchase of SRNA products will not improve chances of winning.
Entries: Use of any automated system or agent to submit entries is prohibited and will result in disqualification. In the event of a dispute as to any entry, the authorized account holder of the e-mail address used to enter will be deemed the entrant. The “authorized account holder” is the natural person assigned an e-mail address by an Internet access provider, online service provider or other organization responsible for assigning e-mail addresses for the domain associated with the submitted address. Potential winners may be required to show proof of being the authorized account holder.
Disclaimer: SRNA and its affiliated and successor corporations, their directors, officers, shareholders, employees and other agents, will not be responsible for: (a) entries that are incomplete, late, lost, illegible, misplaced, misdirected or mutilated; (b) telephone, electronic, hardware, software, network, or other computer-related or communications-related malfunctions or failures; (c) any Sweepstakes disruptions, injuries, losses or damages caused by events beyond the control of SRNA; or (d) any printing or typographical errors in any materials associated with the Sweepstakes. SRNA shall not be responsible for the quality or adequacy of the Prize or any portion thereof or the products or services to be provided to the Prize winner. SRNA will not be responsible or liable for loss or injury resulting from Entrants entering the Sweepstakes, or from the winner’s acceptance or use or misuse of the Prize or any portion thereof. The winner will be required to sign a liability waiver. By submitting an entry, all Entrants accept and agree to these Rules and the decisions of SRNA in administering the Sweepstakes, which shall be final. The winner assumes complete liability for damage to property or injuries to the winner and his or her guests or invitees caused or claimed to be caused by participation in the Sweepstakes, or the use or misuse of the Prize or any portion thereof.
Selection of Winner: One winner shall be chosen by SRNA in a random drawing following completion of the race from among eligible entries received during the Sweepstakes Period. The choice of the winner by SRNA will be final. Each winner may only win once during the Sweepstakes Period. Return of any e-mail notification or prize verification as undeliverable will result in disqualification and an alternate winner will be drawn.
Winner Notification/Prize Awards: Each winner will be notified by e-mail within [fourteen (14) days] of the applicable Prize Date. To accept the Prize, the winner should follow the instructions given by SRNA in its notification. As a condition of being awarded the Prize, the winner will be required to execute and deliver to SRNA a signed Declaration of Eligibility, which includes a certification of age and residence, acceptance of these Rules, a name/image/likeness/voice release and a release of liability. The winner must provide his or her social security number or other taxpayer identification number if the value of the Prize exceeds $599. The winner must sign and return these documents within five (5) days of notification attempt or his or her right to the Prize shall be forfeited and SRNA will select an alternate winner. Prizes will be awarded within approximately fourteen (14) days of receiving the required documents noted above.
Taxes: All federal, state and local taxes (including any sales taxes) associated with the receipt or use of the Prize will be the sole responsibility of the winner. The winner may receive an IRS form 1099 at the end of the calendar year if the value of the Prize is within IRS guidelines, and a copy of such form will be filed with the IRS. Any additional costs relating to the Prize, and incurred as a result of accepting the prize, are the sole responsibility of the winner.
Disclosure of Winner: The identity and state of residence of the Entrant initially chosen as the Sweepstakes winner may be disclosed on the Falken and Dunlop websites, www.falkentire.com,and www.dunlopmotorcycletires.com. If the person initially chosen to be the winner fails to qualify to receive the Prize and an alternate winner is chosen, the identity and state of residence of the alternate winner will be disclosed on the Falken and Dunlop websites as soon as he or she has been chosen.
General Release: By entering the Sweepstakes, you release SRNA and its affiliated and successor corporations, their directors, officers, shareholders, employees and other agents, professional advisors, advertising and promotion agencies, Sweepstakes partners and Prize suppliers from any liability whatsoever, and waive any and all causes of action, related to any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Sweepstakes or the delivery, mis- delivery, acceptance, possession, use of or inability to use the Prize or any portion thereof (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory.
Miscellaneous: The Sweepstakes and these Rules will be governed, construed and interpreted under the laws of the California. If any provision of these Rules is declared to violate any federal, state or municipal law, it shall be amended to conform to such law and all other provisions shall remain in full force and effect. Entrants agree to be bound by these Rules and by the decisions of SRNA, which are final and binding in all respects. Entrants who violate these Rules, tamper with the operation of the Sweepstakes or engage in any conduct that is detrimental or unfair to SRNA, the Sweepstakes or any other Entrant (in each case as determined in SRNA’s sole discretion) are subject to disqualification from the Sweepstakes.
